Coordination Support:
We support communication and coordination between clients and brokers throughout the insurance lifecycle.

Claims Coordination:
We provide coordination support during the claims process, working alongside the appointed broker.

2.2 What Anchorpoint Does NOT Do

Anchorpoint:

  • Does not provide insurance advice or financial product advice

  • Does not recommend, endorse, or guarantee any specific insurance policies

  • Does not arrange, issue, or place insurance policies

  • Does not assess risks or provide coverage recommendations

  • Does not assess, manage, or settle insurance claims

  • Does not hold an Australian Financial Services Licence (AFSL)

  • Is not an insurance broker and does not act as a broker

2.3 No Advisory Relationship

Anchorpoint does not provide advice, and no advisory relationship is created between you and Anchorpoint. All insurance advice, policy recommendations, and coverage decisions are provided by the licensed insurance broker you engage with.

3. YOUR RESPONSIBILITIES

3.1 Provision of Information

You agree to:

  • Provide accurate, complete, and up-to-date information about your business and requirements

  • Notify us promptly of any changes to your information or circumstances

  • Respond to requests for clarification or additional information in a timely manner

3.2 Engagement with Brokers

Once introduced to a broker, you are responsible for:

  • Engaging directly with the broker

  • Providing all necessary information to the broker for risk assessment and policy placement

  • Making your own decisions regarding insurance coverage

  • Paying all premiums, fees, and charges associated with insurance policies

  • Complying with policy terms and conditions

3.3 Due Diligence

You are responsible for:

  • Conducting your own due diligence on the broker and any insurance products

  • Seeking independent professional advice if needed

  • Ensuring the broker and insurance products meet your specific needs

Anchorpoint does not warrant or guarantee the suitability, performance, or outcomes of any broker or insurance product.

4. FEES AND PAYMENT

4.1 Service Fees

Anchorpoint charges a fee for its broker introduction and coordination services. Our fee structure will be discussed and agreed upon during our initial consultation before any introductions are made.

4.2 Payment Terms

  • Fees are payable as agreed in writing

  • Payment is due within [X days] of invoice date unless otherwise agreed

4.3 No Commissions from Brokers

Anchorpoint does not receive commissions, referral fees, or any other payments from insurance brokers or insurers. This ensures our introductions are based on genuine alignment and informed judgment, not financial incentives.

4.4 Broker Fees Separate

Any fees, commissions, or charges payable to the broker for their services are separate from Anchorpoint's fees and are payable directly to the broker.

5. LIMITATIONS OF LIABILITY

5.1 No Liability for Broker Actions

Anchorpoint is not responsible or liable for:

  • The advice, actions, or omissions of any broker

  • The terms, conditions, or coverage of any insurance policy

  • The handling, assessment, or settlement of any insurance claim

  • Any disputes between you and a broker or insurer

  • Any loss or damage arising from the broker's services or insurance policies

5.2 Limitation of Anchorpoint's Liability

To the maximum extent permitted by law:

  • Anchorpoint's total liability to you for any claim arising from our services is limited to the amount of fees you have paid to Anchorpoint

  • Anchorpoint is not liable for any indirect, consequential, special, or punitive damages

  • Anchorpoint is not liable for loss of profits, revenue, business opportunities, or goodwill

5.3 No Warranties

Anchorpoint provides its services on an "as is" basis and makes no warranties or representations, express or implied, including:

  • That brokers will accept your business

  • That you will obtain insurance coverage on specific terms

  • That claims will be paid or settled in a particular manner

  • That our services will meet your specific requirements or expectations

5.4 Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.

6. INTELLECTUAL PROPERTY

6.1 Ownership

All intellectual property rights in our website, content, materials, branding, and services (including text, graphics, logos, images, software, and design) are owned by or licensed to Anchorpoint.

6.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to access and use our website and materials solely for the purpose of engaging our services.

6.3 Restrictions

You may not:

  • Copy, reproduce, distribute, or publish our materials without permission

  • Modify, reverse engineer, or create derivative works

You may terminate our services at any time by providing written notice to Anchorpoint.

If you terminate after an introduction has been made, you remain responsible for any fees incurred up to the date of termination.

8.2 Termination by Anchorpoint

We may terminate our services immediately if:

  • You breach these Terms

  • You provide false or misleading information

  • We reasonably believe continuing the relationship would breach legal or regulatory requirements

  • For any other reason with reasonable notice

8.3 Effect of Termination

Upon termination:

  • You remain liable for any outstanding fees

  • Clauses relating to limitations of liability, intellectual property, and confidentiality survive termination

  • Any introductions already made remain valid

9. DISPUTE RESOLUTION

9.1 Good Faith Negotiation

If a dispute arises between you and Anchorpoint, both parties agree to first attempt to resolve the matter through good faith negotiation.

9.2 Formal Complaints

If negotiation is unsuccessful, you may lodge a formal complaint in accordance with our Privacy Policy and complaints procedure.

9.3 Mediation

If the dispute cannot be resolved through negotiation or our complaints process, both parties agree to participate in mediation before pursuing legal action.

9.4 Governing Law

  • Anchorpoint has no liability for insurance outcomes or decisions

12. REGULATORY COMPLIANCE

12.1 AFSL Status

Anchorpoint Insurance Services Pty Ltd does not hold an Australian Financial Services Licence (AFSL) and is not authorized to provide financial product advice under the Corporations Act 2001 (Cth).

12.2 Broker Licensing

All insurance brokers introduced by Anchorpoint hold appropriate AFSL authorizations and are regulated by the Australian Securities and Investments Commission (ASIC).

You should verify the broker's licensing status on the ASIC Financial Advisers Register: https://moneysmart.gov.au/financial-advice/financial-advisers-register

12.3 Compliance

Anchorpoint operates in compliance with all applicable Australian laws and regulations, including:
