1. INTRODUCTION

These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Anchorpoint Insurance Services Pty Ltd (“Anchorpoint”, “we”, “us”, or “our”). By submitting an enquiry,
engaging our services, or using our website, you agree to be bound by these Terms.

Client/You: The individual or business engaging Anchorpoint’s Services.

Broker: A licensed insurance broker to whom you are introduced.

2. NATURE OF SERVICES
2.1 What Anchorpoint Does
Anchorpoint provides:

Strategic introductions between businesses and licensed insurance brokers;

Coordination support to aid communication between clients and brokers;

Assistance facilitating communication throughout the insurance lifecycle.
2.2 What Anchorpoint Does Not Do
Anchorpoint:

Does not provide insurance advice or financial product advice;

Does not arrange, issue, place, or bind insurance policies;

Does not assess risk, recommend coverage, or manage/settle claims;

Does not hold an Australian Financial Services Licence (AFSL);
-
Is not an insurance broker or agent.
2.3 No Advisory Relationship
Nothing in these Terms creates a financial advisory or fiduciary relationship. All insurance advice, policy recommendations, coverage decisions, and placement are provided by the licensed broker you engage with.
3. CLIENT RESPONSIBILITIES
3.1 Provision of Information
You agree to provide accurate, complete, and up-to-date information and to notify Anchorpoint of changes promptly.
3.2 Engagement With Brokers
Once introduced:

You engage directly with the broker;

You provide all required information to the broker;

You decide on insurance coverage and pay all premiums/charges to the broker or insurer;

You comply with any policy terms and conditions.
3.3 Due Diligence
You are responsible for conducting your own due diligence on brokers and products and for seeking professional advice where needed.
4. REMUNERATION
4.1 No Client Service Fees
Anchorpoint does not charge clients a fee for broker introductions.
4.2 Broker Remuneration
Anchorpoint may receive a referral fee, commission share, or percentage-based remuneration from the broker to whom you are introduced. This remuneration is paid by the broker and does not
increase the cost of your insurance premium and does not impose any obligation on you.
4.3 Acknowledgement
By engaging our Services, you acknowledge and consent to Anchorpoint receiving remuneration from brokers.
5. LIMITATION OF LIABILITY
5.1 No Liability for Broker Conduct
Anchorpoint is not liable for action, omission, advice, or outcomes arising from the broker’s services or insurance products.
5.2 Limitation of Anchorpoint’s Liability
To the extent permitted by law, Anchorpoint’s liability is limited to AUD 100. We are not liable for indirect, consequential loss, loss of profits, revenue, business opportunity, or goodwill.
5.3 Consumer Law
Nothing in these Terms excludes rights you may have under the Australian Consumer Law that cannot be excluded.
6. INTELLECTUAL PROPERTY
All intellectual property on the Website is owned or licensed by Anchorpoint. You may access materials for personal use only and must not reproduce, distribute, or use them commercially without written permission.
7. PRIVACY AND CONFIDENTIALITY
7.1 Privacy
We collect, use, and disclose personal information in accordance with our Privacy Policy (which forms part of these Terms). By using our services, you consent to how we handle your information.
7.2 Confidentiality
Your information is treated as confidential and is only shared with brokers with your consent or as necessary to provide Services, or as required by law.
8. TERMINATION
Either party may terminate engagement in writing. Termination does not affect accrued rights or obligations under these Terms, including limitations of liability.
9. DISPUTE RESOLUTION
9.1 Negotiation
Parties agree to attempt to resolve disputes through good faith negotiation.
9.2 Mediation
If unresolved, parties agree to mediation in Sydney, New South Wales before commencing court proceedings.
9.3 Governing Law
These Terms are governed by the laws of New South Wales, Australia and you submit to the exclusive jurisdiction of the courts of New South Wales.
10. GENERAL PROVISIONS
10.1 Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement, superseding prior understandings.
10.2 Amendments
We may update Terms from time to time; continued use constitutes acceptance of changes.
10.3 Severability
If any provision is unenforceable, it will be severed without affecting other provisions.

Notices must be in writing and sent to the contact details provided above.

Information provided by Anchorpoint is general in nature and does not constitute insurance advice, financial product advice, legal, tax, or accounting advice. You should obtain advice from a licensed broker regarding your specific circumstances before making insurance decisions.
12. REGULATORY COMPLIANCE
Anchorpoint:

Does not hold an AFSL;

Does not provide financial product advice;

Does not arrange insurance products.
Brokers introduced by us hold appropriate AFSL authorisations and are regulated by ASIC; you should verify their status on the ASIC Financial Advisers Register.
13. ACKNOWLEDGMENT
By engaging our Services, you confirm that:

You understand Anchorpoint’s limited role;

You understand we receive remuneration from brokers;

You understand we do not provide advice;

You will seek professional advice from a licensed broker.
